The Website is operated by Grounded Business Advisory Pty Ltd (ABN 57 702 886 011) trading as Grounded Business Advisory (Grounded, we, us or our). These Terms apply when you use the Website. If you do not agree with them, please do not use the Website. You do not need to sign or separately accept anything to read this website.
These Terms are not the client engagement terms — an engagement is agreed separately and in writing.
Purpose of the Website
What the Website is for
The Website provides general information about Grounded, the Grounded Evaluation Review, available support pathways and related business-operating topics. It may also allow you to make an enquiry, book a conversation, subscribe to communications or access resources.
Website content is provided for general information only. It is not tailored advice for your business and is not a substitute for understanding your circumstances through an agreed engagement.
No professional or specialist advice
Nothing here is specialist advice
Nothing on the Website is legal, financial, accounting, taxation, employment-compliance or other regulated professional advice. The Grounded Evaluation Review is a business operating review and not a formal audit opinion. Grounded does not independently verify every statement or document, and its work does not replace specialist advice.
You should obtain appropriate specialist advice before acting on matters that require legal, financial, accounting, taxation, employment, technology, safety or other professional expertise.
No client relationship created by website use
Using the Website, downloading a resource or submitting an enquiry does not create a client, adviser, fiduciary or other professional relationship with Grounded.
A Grounded engagement begins only when its scope, responsibilities, investment and other terms have been agreed in writing. If an engagement document conflicts with these Website Terms, the engagement document applies to the agreed services to the extent of the conflict.
Browsing costs you nothing and commits you to nothing.
Information, availability and changes
Grounded takes reasonable care when preparing Website content but does not promise that every item will always be complete, current, error-free or suitable for a particular purpose. Services, inclusions, availability and investment may change. Current commercial details will be confirmed through the relevant controlled factsheet, proposal or engagement document.
Grounded may update, suspend or withdraw Website content or functionality. Where practical, we will correct material errors after they are identified.
Your responsibility when using the Website
You remain responsible for how you use Website information and for decisions made in your business. Before relying on information, consider whether it is current, relevant to your circumstances and within Grounded’s stated scope.
Do not provide confidential, sensitive or third-party personal information through a general website form unless it is requested and you are authorised to provide it.
Enquiries and information you provide
You must ensure information you submit through the Website is lawful, accurate to the best of your knowledge and does not infringe another person’s rights.
If you provide information about another person, you should ensure you are authorised to do so. Grounded will handle personal information in accordance with its Privacy Policy.
Submitting an enquiry does not require Grounded to accept work or provide a service. Grounded may decline or refer an enquiry where the work is outside its scope or is not an appropriate fit.
Intellectual property
Website content, wording, structure, frameworks, resources, templates, illustrations and branding are owned by Grounded or used with permission. You may read Website content and print or save a copy for your own internal business use. Unless we agree in writing, you must not:
Nothing in these Terms transfers ownership of Grounded’s intellectual property to you.
Acceptable use and website security
You must not use the Website to:
Grounded may restrict access or take reasonable protective action where misuse or a security risk is suspected.
Third-party websites and services
The Website is hosted and served by Netlify. Enquiry and resource-request forms are received by HubSpot, which also holds our contact records and sends consent-based marketing email. Requested resources and transactional or service email are delivered by Resend. The Website may also link to or use booking and scheduling tools, payment services, embedded content or other third-party services. Those services are controlled by their operators and may have separate terms and privacy practices.
A link does not necessarily mean Grounded endorses all content, products or views of the third party. You should assess the third party’s terms and suitability before using its service.
Results, examples and testimonials
Examples, case studies or testimonials describe particular circumstances and do not guarantee that another business will achieve the same result. Outcomes depend on the business, the information available, decisions made, implementation, participation and factors outside Grounded’s control.
Australian Consumer Law and liability
Nothing in these Terms excludes, restricts or modifies a right, guarantee, remedy or liability that cannot lawfully be excluded, including under the Australian Consumer Law.
To the extent permitted by law, Grounded is not responsible for indirect or consequential loss arising solely from use of, or inability to use, the Website or reliance on its general information. This limitation does not apply to loss caused by Grounded’s fraud, wilful misconduct or any liability that cannot lawfully be limited.
These Website Terms do not replace or limit the rights and obligations set out in an agreed client engagement.
Privacy
Grounded handles personal information in accordance with its Privacy Policy, which explains the information collected through the Website, cookies and service providers, access and correction, and how to raise a privacy concern.
The current Privacy Policy is published at groundedbusinessadvisory.com.au/privacy.
Changes to these Terms
Grounded may update these Terms to reflect changes to the Website, business or law. The current version and effective date will be published on the Website. Changes apply from the published effective date and do not retrospectively change an existing agreed client engagement.
Governing law
These Terms are governed by the laws of Queensland, Australia. You and Grounded submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.
General
If a provision of these Terms is found to be invalid or unenforceable, it will be read down where possible and the remaining provisions will continue to operate.
A failure or delay by Grounded to exercise a right does not waive that right.
